Challenge to Initiative 601 moves forward

Posted by Mike Reitz - April 21, 2008

Senate Majority Leader Lisa Brown’s challenge to Initiative 601’s two-thirds supermajority requirement for tax increases took one step forward on Friday. (We wrote about it here, here and here.)

Back in March the Supreme Court denied Sen. Brown’s motion for accelerated review, and sent the matter to the Court Commissioner. The options were to send the matter to trial court, retain the matter in the Supreme Court, or dismiss the entire action.

The Commissioner declined to dismiss the entire action and the case was retained for consideration by the Supreme Court. Here’s the ruling. Brown’s brief is due April 25, and the State’s response is due May 19.

The matter has not yet been scheduled for oral argument.
