WA Supremes...legislature's shell game is OK

Posted by Tom Henry - November 21, 2007

The Washington state Supreme Court took nearly a year to rule on the constitutionality of I-601.  This morning, the Court drop-kicked the issue back to the legislature.

In essence, the court hinted that perhaps the legislature exceeded I-601 spending limits in 2005, but that was alright since the lawmakers went back a year later and retroactively fixed the problem.  Break the law?  Just change the law.  Very simple.  And OK with the state Supreme Court.

The Court skated on the whole constitutionality issue.

Voters recently adopted Initiative 960, which will be the new standard for tax and fee increases. However, a constitutional amendment may be necessary to ensure an iron-clad spending limit that the legislature cannot circumvent with budgetary shell games.
